Users may also access public informational content around F/S Manufacturing. Users must use this website only for lawful purposes and in accordance with these terms and conditions. We reserve the right to restrict access to users who use the website in any way that harms F/S Manufacturing (“us”) or any other users.
We reserve the right to restrict access to users who input false contact information, submit fake quote requests, impersonate another person or business, or intentionally mislead dealers. Access may also be restricted to users who attempt to hack the website, upload malware, infringe intellectual property, or otherwise take action to disrupt the website.
F/S Manufacturing (“we”) reserve the right to modify website content or change these terms and conditions at any time.
Quote requests signify product inquiries only and not purchases. By using this website, you understand that your quote requests may be sent to local and applicable dealer(s). Sending a quote request to a dealer(s) does not guarantee a purchase, relevant product availability, dealer response, or certain pricing. Users are responsible for accurately submitting information which determines dealer response and we cannot guarantee timely response from dealers. Final sales terms are determined by the dealer users choose to work with and not by F/S Manufacturing.
Dealers operate independently of this website. Dealers may contact you post quote submission via email or phone. By submitting a quote request, users consent to receive communication from chosen dealers. Any dealer communications and offers are outside of F/S Manufacturing’s control.
Product specifications may change without notice, and catalog or other product resource information may not always be current. Product photos and descriptions may be illustrative.
All orders are subject to acceptance or denial by F/S Manufacturing. F/S Manufacturing will confirm acceptance of an order through email or a shipment of the product(s). Special handling, expedited shipping instructions, or general shipping instructions are required at the time of order. Any shipping instructions that require additional time may result in an extra handling fee.
The price shall be the price quoted, or if no price is quoted, the price shall be the current public pricing plus any applicable surcharges. Unless specifically stated, prices do not include freight, insurance, sales taxes, duties, customer broker fees, or other similar taxes and charges. These items shall be the sole responsibility of the customer and the customer may be invoiced for these charges by F/S Manufacturing.
F/S Manufacturing may increase prices or impose surcharges as necessary due to special circumstances. Dealer pricing is subject to change and may vary by dealer. All pricing is in US dollars and all payments shall be made in US dollars. Payment by credit card for discounted orders will result in an additional credit card fee. Past due bills are subject to a 1.5% per month service charge or the maximum rate permitted by applicable law, whichever is less.
Product availability may change at any time, and lead times are estimates only. F/S Manufacturing will have no liability if the product fails to ship within the estimated lead time.
All dealers shall independently determine product pricing, financing, warranties, inventory, and delivery. F/S Manufacturing cannot guarantee completed transactions through a dealer. F/S Manufacturing also takes no responsibility for dealer conduct or any transaction disputes. Quote requests or other product inquiries do not represent binding agreements.
Cancelled orders may result in a fee, which will be dependent on the actual items ordered and the status of the items ordered.
Any products not manufactured by F/S Manufacturing are not covered under the F/S Manufacturing warranty but are subject to the manufacturer’s warranty. F/S Manufacturing (“we”) will facilitate the warranty claim and pass through the warranty coverage.
This warranty is the sole and exclusive warranty made by F/S Manufacturing. No other express or implied warranty of any kind, oral or written, including any implied warranty of merchantability or fitness for a particular purpose, is made with respect to the quality, workmanship, materials, design, performance, fitness or suitability of any F/S Manufacturing or other product.
We warrant that products excluding polyethylene tanks will be free of defects in material and workmanship under normal use for a period of 1 year from the date of purpose by the end user. We also warrant that polyethylene tanks will be free of defects in material and workmanship under normal use for a period of 12 months from the date of purchase. For months 12 through 60, the warranty provided will be prorated based on the purchase date. Credit provided towards tank replacement will be based on the retail price on the date of the warranty claim.
All warranties are limited to the repair or replacement of the defective part. Expenses, mileage, inconveniences, or other damages that may occur are not subject to warranty consideration.
We make no guarantees regarding product suitability or performance expectations. The end user or purchaser is responsible for determining if the product is suitable for the specific use case.
Merchandise may only be returned upon our authorization and special order items cannot be returned. Used sprayers also may not be returned. Once authorized, merchandise must be returned within 90 days of purchase through freight prepaid. All returns must specify the invoice number and the purchase date of the item(s).
The final return credit issued will be subject to our inspection to determine the condition of the item(s). Credit will only be issued for new condition items for the net invoice cost minus all freight charges, allowances, discounts, or restocking fees.
We (FS Manufacturing) own all website content, including but not limited to blogs, catalogs, downloadable materials, logos, trademarks, and graphics. This intellectual property may not be used without our explicit written consent.
We cannot guarantee uninterrupted website access, the accuracy of our website, or any level of dealer responsiveness.
The user shall determine the suitability of the product for its intended use and assume all risks and liability in connection with its use. In no event shall F/S Manufacturing have any liability in connection with any order or product for special, incidental, indirect, consequential or punitive damages, including, but not limited to any loss of sales, profits, income or business, loss of contracts, loss of goodwill, damage to reputation, loss of property, or loss of information or data, whether or not advised of the possibility of such damages.
We are not responsible for inaccurate dealer information or third party communications whether through our website or otherwise. Users choose to interact with dealers at their own discretion.
F/S Manufacturing is not responsible for any delays or other issues caused by events outside of its control. This includes but is not limited to, internet outages; transportation disruptions, natural disasters; fire; flood; storm; explosion; government actions; supply chain disruptions; pandemics; power failures; war; riot; civil disturbance; act of terrorism; accident; sabotage; theft; malicious damage; confiscation; nationalization; embargo; compliance with law, rule, regulation or governmental or regulatory order or directive; act of government or authority; interruption, shortage or restriction in power, utilities, materials, parts or components; damage or destruction of facilities or equipment; strike; lockout; labor dispute; labor shortage; epidemic or other widespread illness; or breach or default of suppliers or subcontractors.

Quotes, orders, acceptances, and these Terms and Conditions shall be governed by and interpreted in accordance with the laws in the State of North Dakota, and the rights, liabilities and obligations of F/S Manufacturing and the Customer shall be determined under the State of North Dakota.
F/S Manufacturing reserves the right to modify these Terms and Conditions at any time at its sole discretion. Continued use of this website constitutes acceptance of these Terms.
